Item 8.01.
Other Events.
 
As previously disclosed, on February 29, 2008, the Circuit Court of Pulaski County Arkansas entered judgment in the case captioned Parks Land Company, et al. v. Western Sizzlin Corporation, et al. against Western Sizzlin Corporation (the “Company”) in the amount of $689,526.   On appeal by the Company, on May 14, 2007, the Arkansas Supreme Court reversed and remanded the case for a new trial.  On June 25, 2009, the Arkansas Supreme Court issued a per curiam order denying Parks Land Company’s petition for a rehearing.  As previously reported, the Company has accrued $900,000 related to this loss contingency.
