Don’t think that drinking coffee or taking a cold shower or a walk can make you sober. While you may feel more awake, the alcohol in your blood stream still makes it dangerous for you to drive. The level of impairment for motorists who consumed alcohol is dependent on five factors. These include the amount of alcohol drank, body weight, gender, the length of time the person drank alcohol, and the amount of food eaten before or while drinking alcohol. The Blood Alcohol Content (BAC) is a measurement of the concentration of alcohol in the blood and has been found to be the best predictor of the likelihood of involvement in a motor vehicle crash.

There are various types of drug- and alcohol-related violations in the state of New York. When the BAC is 0.08 or higher or other evidence of intoxication, the violation is Driving While Intoxicated (DWI). For drivers of commercial motor vehicles, the BAC threshold is 0.04 or other evidence of intoxication. If the BAC is 0.18 or higher, the violation is Aggravated Driving While Intoxicated (Aggravated DWI).

It is also important to know the difference between DWI vs. DUI. When the BAC is more than 0.05 but less than 0.07, the offense is Driving While Ability Impaired by Alcohol (DWAI/Alcohol). When the motorist had taken a drug, the offense is Driving With Ability Impaired by a Single Drug Other Than Alcohol (DWAI/Drug). And if the motorist is both impaired by alcohol and drugs, the offense is Driving With Ability Impaired by a Combined Influence of Drugs or Alcohol (DWAI/Combination). Meanwhile, a driver who refuses to take a chemical test will be charged with Chemical Test Refusal while a driver who is less than 21 years old and drives with a BAC of 0.02 to 0.07 is in violation of the Zero Tolerance Law.

These violations are punishable with fines and/or jail term and revocation of driver’s license. Aggravated DWI has a mandatory fine of $1,000 to $2,500, one year jail term, and revocation of license for one year. DWI or DWAI-Drugs has a fine of $500 to $1,000 and one year jail term and revocation of license for at least six months for DWI and suspension of license for at least six months for DWAI-Drugs.
