
Assembly Bill 2777 Extends the Statute of Limitations in California for Sex Abuse Victims Allowing More Time to Seek Compensation from Abusers

New laws have gone into effect that increase the statute of limitations for sex abuse victims, as well as increase the rights survivors can exercise. California Assembly Bill 2777 and AB 218 help people by allowing more time for survivors to pursue civil actions against their abusers. • The state has eliminated the deadline to file a childhood sexual abuse lawsuit for people who were abused on or after January 1, 2024. The legislation allows survivors to bring a civil action anytime.
• Sex abuse that occurred before January 1, 2024, and before the abuse survivor was 18, a civil lawsuit can be filed until they are 40. If the victim discovers the abuse after being 40, they can file a lawsuit within five years of discovering psychological injury caused by the abuser.
• If the sex abuse occurred after the victim was 18, the new legislation has increased the statute of limitations to 10 years after the abuse or 3 years from realizing injury caused by the abuse.
There have been constant major headlines in the news about sex abuse victims.
