Item 8.01		Other Events.

On April 14, 2011, the Corporation received an imminent danger order issued by the Mine Safety and Health Administration under section 107(a) of the Federal Mine Safety and Health Act of 1977 at its Rocky Point quarry in Rocky Point, North Carolina. The order was issued when a section of high voltage power line cable was observed lying on the ground and along the edge of the mine’s entrance road. The cable was attached to the top of the power pole and the portion on the ground was approximately 3 feet to 4 feet from the energized A/C transformer connectors. Although the Plant Manager called the power company, the area was not guarded or barricaded to prevent entry. The order was lifted after the power company repaired the cable.
