Other Events and Regulation FD Disclosure. On September 3, 2003, the United States Court of Appeals for the Federal Circuit affirmed the August 13, 2002 judgment of the United States District Court for the District of Colorado in the Materna(TM) litigation. As a result of its contract with the University of Colorado Foundation, Competitive Technologies, Inc. (CTT) shares 18.2% of damages after attorneys' fees. If this judgment is not appealed, CTT's share would be approximately $4.7 million plus its proportionate share of interest. Although the defendant may appeal this judgment, based on the language of this September 3, 2003 judgment, CTT's management believes there is a reasonable possibility that this lawsuit will finally be settled and it will receive its share of damages finally awarded. CTT has recorded no potential judgment proceeds in its financial statements to date. CTT will record revenue for judgment proceeds when it receives them.
